Nothing that happened here fits the Harassment statute as defined by PA and the Ethnic Intimidation charge only sticks if the Harassment charge prevails. She'll likely plea out but it's not exactly clear she would lose if she were stupid enough to push it to trial.

There is no "Hate Speech" statute in PA. It's an enhancement charge of Ethnic Intimidation. In this case, it's secondary to the charge of Harassment--which is an overreach on the prosecutor's part. All things considered she'll probably plea out and the overreach won't matter.
